Terms of Use – Insightable app

1. About these Terms

We have written these Terms in plain language so you can see how the App works, including the optional paid subscription. We also adopt Apple's Licensed Application End User License Agreement (Standard EULA). If there is a conflict between these Terms and Apple's Standard EULA about your licensed use of the App through the App Store, Apple's Standard EULA applies to that conflict.

2. The App

Insightable is a guided meditation app. Full access to the meditation library requires an auto-renewable annual subscription, purchased through Apple. The App shows the current price in your App Store currency before you subscribe.

Meditation content is for general wellbeing and self-reflection only. It is not a substitute for professional medical, psychological, or clinical advice, diagnosis, or treatment. If you have concerns about your mental health, please speak with a qualified health professional.

We add new guided sessions over time so the subscription continues to offer value through the year.

3. Subscriptions and payments

The App offers an auto-renewable annual subscription purchased through Apple In-App Purchase.

• Title: Insightable annual subscription
• Length: one year
• App Store product identifier: app.insightable.annual.subscription
• Price: set in App Store Connect and shown in the App in your App Store currency. A US Apple ID sees USD; an Australian Apple ID sees AUD. We do not list a fixed price here because it varies by country and Apple ID.
• Payment is charged to your Apple ID when you confirm the purchase. Insightable does not collect or store your card details. Apple processes the payment.
• The subscription renews automatically each year until you cancel it in Apple's subscription settings.
• Your Apple ID is charged for renewal within 24 hours before the end of the current period, unless you turn off auto-renew at least 24 hours before then.
• There is no free trial.

4. Managing, cancelling, and restoring

You manage and cancel the subscription in Apple's subscription settings, not inside a billing portal we operate. On iPhone, go to Settings, tap your name, then Subscriptions. You can also use the Manage subscription link in the App (Settings) where we provide it.

Cancelling stops the next renewal. You keep access until the end of the period you have already paid for.

If you reinstall the App or use a new device signed in with the same Apple ID, use Restore purchases in the App (Settings) to recover your subscription.

Refunds are handled by Apple, not by Insightable. To request a refund, use Apple's Report a Problem process.

5. Using the App

You agree to use the App in good faith and not to:

• Attempt to access, interfere with, or disrupt the App or its infrastructure
• Copy, redistribute, or scrape App content except as allowed by law
• Use the App in any way that could harm other people or impair the service

We may update, add, or remove sessions and features from time to time.

6. Intellectual property

All content in the App, including guided sessions, scripts, recordings, text, and branding, is the intellectual property of Insightable Mind or its licensors. You may use the App for your own personal wellbeing. You may not reproduce, distribute, modify, or create derivative works from this content without our prior written consent, except where the law allows.

7. Privacy

How we collect, use, and protect personal information in the App is explained in the Insightable app Privacy Policy. That policy also covers purchases processed by Apple.

8. Apple's Standard EULA

In addition to these Terms, your licensed use of the App through the App Store is subject to Apple's Licensed Application End User License Agreement (Standard EULA).

9. Disclaimers

The App is provided as is and as available. While we work hard to keep it reliable, we cannot guarantee it will always be uninterrupted or error-free. We make no warranties, express or implied, about the App's fitness for any particular purpose, except where Australian law requires otherwise.

Meditation content does not constitute professional medical, psychological, or clinical advice, and should not be treated as a substitute for guidance from a qualified professional.

10. Limitation of liability

To the maximum extent permitted by applicable law, NovoPsych Pty Ltd and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of or inability to use the App.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Australian law, including under the Australian Consumer Law.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising in connection with these Terms or the App are subject to the exclusive jurisdiction of the courts of New South Wales, Australia, except where Apple's Standard EULA provides otherwise for your licensed use of the App through the App Store.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will do our best to notify you in the App or by email. Continued use of the App after an update constitutes acceptance of the revised Terms.
